IN THE CASE OF NON-RESIDENT INDIANS THE DISTRICT REVENUE OFFICERS OF ALL THE DITRICTS HAVE BEEN CONFERRED WITH THE POWERS OF ASSISTANT COLLECTOR 1ST GRADE/2ND GRADE TO DECIDE THE CASES OF CORRECTION OF KHASRA GIRDAWRI, PARTITION, UNCONTESTED MUTATIONS, REGISTERED WILLS, LAMBARDARI CASES, CHOWKIDARI CASES, AND DEMARCATION CASES. AS ASSISTANT COLLECTOR 1ST GRADE THEY WILL HAVE THE POWERS TO DECIDE THE CASES OF UNREGISTERED WILLS, CONTESTED MUTATIONS, RENT SUIT, EJECTMENT U/S 6(3) OF THE PUNJAB LAND REVENUE ACT 1887.

Some typical examples of exploitation in certain situations.

1. Suppose “A” Purchases a portion or chunk of land from “B”. Patwari enters the mutation wrongly, say, omits some khasra numbers deliberately or by mistake.The kanungo who is responsible for checking of the entries also fails to point out the defects.Tehsildar or Naib Tehsildar sanctions the mutation as such overlooking the wrong entries.With the passage of time new jamabandi gets prepared carrying the wrong entries. More time passes but “A” the purchaser is not aware at all. After 10-12 years “A” approaches the PATWARI, gets the farad but to his dismay there are major mistakes in the farad. “A” as a natural corollary asks for correction but PATWARI and even the Tehsildar says that “A” will have to go to the civil court for correction of Jamabandi entries. Here starts the long ordeal of that hapless man. “A” will either be profusely bled or will have to undertake rounds of civil courts for years. Question is what is the fault of “A”.It is the department who is at fault and also supposed to correct entries at its level. Such helpful approach is seldom applied. Now “A” need not to worry. 2. Suppose “A” is a landlord or a colonizer. He sells plots to “B”,”C”,”D”&”E” at different intervals of time spanning over about 5 years or 10 years. Out of the above purchasers “C”,”D”&”E” get the mutations entered and sanctioned in their names. Their names even figure in the subsequent Jamabandi. “B” does not know law , never approaches the patwari nor verifies from the patwari at any stage. He keeps the sale deed although he has taken over the possession at the time of purchase. After this “B” wants to sell his share of land and goes to the patwari , asks for fard where upon the patwari tells him that he is not the owner of that land and hence no fard can be given. In this case what has happened?

Actually “B” Should have got the mutation sanctioned in his name immediately after purchase. “A” The land lord knowing fully well such instances goes on selling the land beyond his share taking advantage of the wrong or deficient entries in the jamabandi. Until and unless B’s name is incorporated in the jamabandi, he does not become the owner in the revenue records. In such situations see the fate of “B” and especially when the department advises him that it can do nothing. There is provision in the revenue law to rectify such mistakes.
